Please read the following terms of sale carefully before submitting your order to mystanduppaddle.com.

TERMS OF SALE

  1. APPLICABILITY

These terms of sale apply to all orders that you (“customer / you”) place through the website in relation to products advertised on the website, as well as to all contracts between you and mystanduppaddle.com for the sale of such products. When you place an order at mystanduppaddle.com on the website, you agree to the application of these conditions of sale to your order. Each time you order products through the website, the then applicable sales conditions apply to your order. So please review these Terms of Sale to make sure you understand what terms apply at this point in time.

  1. TERMS AND CONDITIONS FOR CONCLUDING A CONTRACT WITH mystanduppaddle.com

You may only order products through the website if you are at least 18 years old and are purchasing products as a consumer (which means that you are not buying any products in the context of your trade, business, craft or profession).

You are solely responsible for ensuring that all information provided during registration or during the ordering process is correct and complete.

  1. CONCLUSION OF THE CONTRACT

You can place our products in your shopping cart on the website without obligation and correct your entries at any time before submitting your order by using the correction aid provided for this purpose during the ordering process.

When you place an order you should receive an email from us confirming that we have received your order (please contact us if you do not receive this email). This confirmation of receipt does not mean that your order has been accepted. It is only used to inform you that the order has been received by mystanduppaddle.com.

We will confirm in a separate confirmation email when your order has been accepted. When we send this confirmation e-mail, a contract is concluded between us under these conditions of sale for the delivery of the products specified in the confirmation e-mail.

All orders are subject to our acceptance. Mystanduppaddle.com reserves the right to refuse an order without giving a reason. For technical reasons we cannot accept orders by phone, email, fax or post.

  1. OUR PRODUCTS

If we are unable to accept your order (e.g. if the products you have ordered are out of stock or not available at the time you place your order), we will notify you in writing and will not charge you any fees for the products. Payments already made will be refunded immediately.

We can make minor changes to a product to reflect changes in relevant laws and regulatory requirements. If we need to make material changes to a product you have ordered, we will notify you and you can continue or cancel your order in relation to the affected products.

The images of the products on the website are for illustrative purposes only. While we have made every effort to accurately display the colors, we cannot guarantee that the display of colors will be accurately reflected on every device. Your products may differ slightly from these images.

  1. LANGUAGE AND STORAGE OF THE CONTRACT

These conditions of sale and all contracts between us are in German. We will not save a copy of your contract. We recommend that you keep a copy of the relevant Terms of Sale that apply to your order for reference.

  1. OWNERSHIP OF PRODUCTS

You will own the products once we have received full payment.

 

  1. CHANGE YOUR ORDER

Your order will be forwarded to our logistics team for processing as soon as possible. Once we have started processing your order, you cannot cancel or change it before delivery.

  1. PRICE

The prices are stated on the website in the appropriate currency depending on the setting or zone where they are located, including VAT (if applicable) at the applicable rate, but excluding shipping costs. The shipping costs are to be paid additionally and are shown separately during the ordering process.

We can change the prices on the website at any time and without prior notice. However, changes will not affect orders that we have already accepted. However, if the VAT rate changes after the date of your order, we will adjust the VAT rate you paid, unless you have already paid in full for your order before the VAT change takes effect.

It is always possible that, despite our best efforts, some of the products listed on the website are incorrectly priced. We usually check prices before we send a confirmation email so we can see:

(a) The correct price of a product is less than the price listed on your website at the time of your order.

(b) The correct price of a product is higher than the price stated on our website at the time of your order. We will, at our discretion, either refuse your order and notify you of such refusal or contact you to give you the option to continue ordering at the higher price or cancel your order.

If we accept and process an order where there is an obvious price error, we reserve the right to terminate the contract, refund amounts already paid and request the return of products that have already been received.

  1. PAYMENT METHODS

We offer the following payment options: Credit card and PayPal. However, with every order we expressly reserve the right not to accept certain payment methods and to refer to other payment methods. Under no circumstances will we assume the cost of a payment transaction.

During the ordering process you will be asked to select the payment method you have chosen.

  1. ADVERTISING COUPONS

Advertising vouchers are vouchers that we issue as part of advertising campaigns with a certain period of validity and that cannot be purchased. Promotional vouchers can only be redeemed in certain countries (and on the corresponding pages of the website) and in relation to a limited number of items or product categories. Promotion vouchers are only valid for a certain period of time and can only be redeemed once per order. Some promotional vouchers can only be redeemed once in total. Promotional vouchers cannot be combined.

Advertising vouchers can only be redeemed during the ordering process. They cannot be used after your order has been completed and are not transferable for cash.

A promotional coupon used to purchase products will not be refunded or re-credited if all or some of the goods purchased are returned.

Please note that additional terms and conditions or restrictions may apply to the use of promotional vouchers. We reserve the right to refuse to accept coupon codes that are invalid for your order or that have expired.

  1. DELIVERY AND COLLECTION

Each order is sent to a specific delivery address in Europe of the customer's choice.

Please note that shipping dates and times are estimates only and time is not critical. The delivery times apply from the date on which we accept your order.

13.1. Delivery directly to you

All orders without hardboard will be delivered to an address specified by you within Switzerland and in Europe, which you specified by parcel delivery or shipping service. The delivery cannot take place outside of Europe. We do not deliver to parcel stations.

The delivery of your order is complete when we deliver the products to the address you have provided. The products are your responsibility and the risk for the products passes to you from the time they are in your possession or in the possession of someone you choose to accept.

If there is no one available at your address to receive the delivery and the products cannot be sent through your mailbox or a signature is required to accept delivery, we will leave you a message letting you know how to get the delivery Reorder delivery or pick up products at a local depot. If, after a failed delivery to you, you fail to re-arrange delivery or collect your products from the delivery depot where they are held, we will contact you for further instructions and may charge you for storage and other delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection, 

  1. CONSUMER RIGHT OF RETURN AND REFUND

Right of withdrawal and exercise

If you are a consumer in the European Economic Area, you have the right to change your mind and terminate your contract within 14 days of receiving the goods. If the products are split into several deliveries on different days, you have up to 14 days after the date on which you or someone named by you received the last delivery.

Consequences of cancellation

If you cancel your contract, you will be responsible for returning the products to us. You must return the products to us within 14 days of notification. All products must be returned to us using the return form and label supplied with the delivery. The costs for the return are at your expense. The address for the return is:

We will refund you for the price you paid for the canceled products, excluding the fees you paid for delivering the products to us. We will refund this amount according to the method you used for payment, unless you agree otherwise. We will pay this refund either within: (a) 14 days after the day we receive the products back from you or, if earlier, on the day you provide us with evidence that you have returned the products to us to have; or (b) 14 days after you have notified us of your decision to withdraw from the contract (if we have not yet started processing your order). Please note that if the products are defective, we can reduce your refund,

  1. DEFECTIVE PRODUCTS AND LEGAL WARRANTY

If you are a consumer, we are legally obliged to deliver products in accordance with the contract. Nothing in these Terms of Sale affects your statutory rights in relation to defective Products (including a right to a refund and / or a right to repair or replacement).

If you believe that a product we have supplied is faulty or incorrectly described, please notify us using the contact details provided in Section 11. You must return these products to us according to our instructions.

We grant guarantee services within the framework of the applicable statutory provisions of the respective country.

  1. LIABILITY

If we fail to comply with these Terms of Sale, we will be responsible for any loss or damage you suffer which is a foreseeable consequence of our breach / failure to use reasonable care / skill. However, we are not responsible for any loss or damage that may arise unpredictably. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was signed, both we and you knew it could happen.

We only supply the products for domestic and private use. If you use the Products for commercial, business, or resale purposes, we will not be liable to you for any loss of profit, loss of business, loss of anticipated savings, business interruption, or loss of business opportunity.

  1. EVENTS OUTSIDE OUR CONTROL

We will not be liable or responsible for any failure to perform or delay in performance of our obligations under any contract caused by any act, event, omission or accident beyond our reasonable control. If an event occurs beyond our control that affects the performance of our contractual obligations, we will contact you as soon as possible to notify you. Our contractual obligations are suspended and the time to fulfill our obligations is extended for the duration of the event beyond our control. If the event beyond our control affects the delivery of products to you, we will arrange a new delivery date with you,

You can terminate a contract that is affected by an event beyond our control if there is a risk of significant delay. To terminate a contract under this Clause 18, please contact us using the details provided in Clause 11.

  1. SEVERABILITÄTSKLAUSEL

Each of the paragraphs of these conditions of sale apply separately. If a court or competent authority determines that any or part of them are illegal or unenforceable, the remaining provisions will remain in full force and effect.

  1. APPLICABLE LAW AND JURISDICTION

Nothing in these Terms of Sale affects your rights as a consumer under applicable law in the jurisdiction in which you are resident.

Every contract for the purchase of products from us and all disputes or claims arising from or in connection therewith are subject to Swiss law, provided that it does not override any mandatory laws of the country in which you have your main residence.

The provisions of the UN Sales Convention do not apply.

In relation to disputes or claims in connection with a contract, you and we both submit to the non-exclusive jurisdiction of the Swiss courts. However, nothing in this clause restricts your statutory rights to bring an action against us or to request proceedings in the country in which you have your habitual residence.
